Perfumeshots shall be released from its obligations under these Terms of Service to the extent that it is prevented from or delayed in performing, either wholly or in part, due to an event or series of events arising from or caused by (1) weather conditions or other natural elements, acts of God, (2) war, terrorism, insurrection, riots, civil unrest, or rebellion, (3) quarantines or embargoes, (4) labor strikes, or (5) other causes beyond Perfumeshots's reasonable control.

International Use

We do not guarantee that information available in connection with the Site is suitable or available for use outside the United States. Those who access the Site from outside the United States do so at their own risk and are responsible for compliance with local laws, if applicable.

Risk of Loss

Items purchased through the Site are shipped by a third-party carrier based on a shipment agreement. Consequently, the risk of loss and title for these items pass to you upon our delivery to the carrier.

Dispute Resolution

Recognizing the substantial expense linked to legal conflicts, not just in terms of finances but also regarding time and effort, through any utilization of the Site, you and Perfumeshots unwaveringly provide your consent and reach an agreement that:

(2) This arbitration pact is established in conjunction with a transaction encompassing interstate commerce and will be governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1-16;

(3) At your discretion, arbitration could transpire through video, telephone, or be limited to a documents-only format; otherwise, the arbitration will be held in Singapore;

(4) The pronouncement of the arbitrator shall be directed by these Perfumeshots Terms of Service and any other agreements alluded to herein that the pertinent user might have entered into in relation to the Site;

(5) tThe arbitrator shall apply the laws of Singapore, in alignment with the FAA and pertinent statutes of limitations, and shall respect the recognized privileges as mandated by law;

(6) No authorization shall be granted for any claims to be subjected to arbitration in a collective or representative fashion (refer below for detailed information); the scope of arbitration is confined to your own and/or the applicable Perfumeshots, or any of its executives', directors', and staff members', individual claims; the arbitrator shall not merge or amalgamate the claims of other persons or parties who may be in a similar position;

(7) The arbitrator is devoid of the authority to bestow punitive damages upon you, Perfumeshots, or any of its executives, directors, and staff members;

(8) Should the administrative fees and initial payments required to launch arbitration against Perfumeshots or any of its executives, directors, and staff members exceed $125 USD, and you are incapable of covering fees and payments that exceed this threshold (or if such payments are not obligatory under the rules of JAMS) Perfumeshots commits to undertaking the payments and/or forwarding them on your behalf, contingent on the final allotment determined by the arbitrator. Furthermore, if you can substantiate that the costs related to arbitration would be excessively onerous compared to litigation expenses, Perfumeshots will cover a substantial portion of your filing and hearing fees associated with arbitration, to the extent considered essential by the arbitrator to avoid making arbitration economically unviable;

(9) With the exception of subpart (6) above, if any component of this arbitration stipulation is adjudged invalid, unenforceable, unlawful, or in opposition to the regulations of JAMS, then the remaining content of this Dispute Resolution stipulation shall persist in force and shall be interpreted in harmony with its provisions, as if the void, unenforceable, unlawful, or conflicting component were not included in this document. Solely the arbitrator is granted the authority to make determinations concerning the scope, legality, or enforceability of this Agreement, inclusive of whether any dispute falls within its purview. However, if subpart (6) is held to be invalid, unenforceable, or unlawful, the entire Arbitration Provision shall be rendered null and void, rendering neither you nor Perfumeshots entitled to arbitrate their discord.

The assertions, disagreements, or disputes encompassed by this provision shall be as comprehensive as permissible by law. This encompasses claims grounded in contract, tort (comprising intentional tort), fraud, agency, your or our negligence, legislative or regulatory stipulations, or any other legal sources; claims presented as counterclaims, cross-claims, third-party claims, interpleaders, or in any other form; and claims presented individually or combined with other claims. In the context of this arbitration agreement, Perfumeshots includes its parent company, subsidiaries, divisions, or affiliates and their respective executives, directors, staff members, agents, or successors.

Informal Dispute Resolution Procedure. In cases where a party puts forth a claim, the party shall initially attempt to settle it in good faith by transmitting a written notification, as outlined below, to the other party, elucidating the specifics and circumstances (comprising any pertinent documentation) and granting the receiving party a period of 60 days to reply. The notice should be transmitted through first-class or registered mail:

(1) To Perfumeshots, Attention: Legal Department, 11 Bedok North Ave 4, Singapore 489949;

(2) To you at the billing address recorded with Perfumeshots. You and Perfumeshots concur that this protocol for resolving disputes is a prerequisite that must be met prior to instigating any arbitration against the other party. Both parties are mandated to enclose a copy of the notice and substantiation of mailing when lodging an arbitration demand.

WAIVER OF CLASS ACTION. All arbitration procedures will be carried out on an individual basis. You and Perfumeshots also mutually relinquish the entitlement to a jury trial, to initiate or join any class action lawsuit or class action arbitration, any lawsuit or arbitration functioning as a private attorney general, and any lawsuit or arbitration joined or amalgamated in any form. Should a court rule that the restrictions outlined in this section pertaining to the waiver of class action are found to be invalid or unenforceable, any prospective class action, private attorney general, or representative action must be introduced in a court possessing appropriate jurisdiction, rather than through arbitration.

Continuance. This Arbitration Agreement maintains its validity beyond the cessation of the association between you and Perfumeshots. This encompasses the termination of your Perfumeshots membership, the removal or cancellation of your Perfumeshots account, opting out of marketing, or the conclusion of your participation in any Perfumeshots initiative or service.
